Financial security for post-paid accounts

    Users wishing to use the post-paid account option when signing the contract must provide appropriate security. This may take the following form:

    - Bank guarantee – Users are required to obtain a Bank Guarantee and present it physically at the CP for verification. A post-paid agreement is subject to Bank Guarantee approval, a process which may take several working days to conclude. In order to expedite the approval process all issued Bank Guarantees should comply with the form available at: link,

    - insurance guarantee – Users are required to obtain an Insurance Guarantee and present it physically at the CP for verification. A post-paid agreement is subject to Insurance Guarantee approval. Opening of a post-pay account is possible after receipt of the approval of Insurance Guarantee. The process which may take several working days to conclude. In order to expedite the approval process, all issued Insurance Guarantees should comply with the form available at: link,

    - cash - users are obliged to fill out a payment declaration form and credit the numbered account with the stated amount. Road users may only sign a contract upon crediting the bank account with the full amount. The payment declaration form is available at: link

    - appropriate guarantee from a third entity, who meets the conditions indicated in §6 section 1. 4 of a Regulation of the Minister of Infrastructure and Development of 27 August 2015 on the settlement and accounting of electronic toll payments to the account of the National Road Fund (a third party may be, for example, a fleet card supplier, through which a toll-road user using the post-pay account may make payments).

    Appropriate security should secure the full amount of expected charges, taking into account the monthly settlement period, and should be made for a period of not less than 1 year. A bank guarantee template, (one of the stated methods of securing electronic toll payment) is available at each DP and CP, and can be accessed at www.viatoll.pl. The guarantee may be issued in either Polish or English - documents in other languages will not be accepted. The guarantee must satisfy all the relevant provisions contained in the sample form. Failure to do so will result in the guarantee being rejected.

    The amount subject to a guarantee shall be calculated on the basis of vehicles registered (or forecast) for a user account, and the projected use of the toll road network. It must cover the maximum use of the toll road network for 1.5 months (monthly debit note + 14 days maturity). If additional vehicles are added to the user account, the user is required to increase the amount of the guarantee, as necessary; the basic principle being that notwithstanding the number of vehicles registered in the account, the total amount payable for toll use must be covered by a guaranteed amount.     Users shall be notified of the impending expiry date of the guarantee 60 days in advance, for the user to submit a renewed guarantee no later than 30 days before the expiry date. This does not mean that users are exempt from monitoring the validity and amount specified in the security guarantee. Should the user fail to renew the warranty 30 days prior to the expiry date, or if the amount due for electronic toll collection amounts to 99% of the value of the amount specified in the guarantee, the user account automatically changes to the pre-paid type with a balance equal to 0 PLN. In such a situation, the user will be required to observe the General Terms and Conditions for such a user account at: www.viatoll.pl, without having to change the agreement or undertake other actions by the parties.
